Cabinet approves to amend Cinematograph Act, inserts penal provisions for unauthorized camcording & duplication of films

In order to tackle the menace of film piracy Govt. has approved to introduce Cinematograph Amendment Bill, 2019. Under the Bill, Ministry of Information and Broadcasting would line to insert Section 6AA which states that,

 “Notwithstanding any law for the time being in force, no person shall without the written authorization of the author be permitted to use any audio visual recording device to knowingly make or transmit or attempt to make or transmit or abet the making or transmission of a copy of a film or a part thereof.”

The above provision restricts people to use any form of audio visual recording device  for attempting or transmitting or making the copy of the film or a part of it without the written authorization / permission given by the author.

Incase of the violation of Section 6 AA, penal provision Section 7 (1A) has also been inserted in the Bill. Section 7(1A) states that the person who violates Section 6 AA would be punishable with the imprisonment which might extend to 3 year or with the fine that may extend to Rs. 10 lakh or with both.
